MacGillivray Law secures compensation for victim of workplace harassment

We often represent victims of sexual abuse against organizations, where abusers often join in order to exploit vulnerable young people such as Boy Scouts, Air Cadets, and others where they assume a position of authority. This case was a bit different than that, but we were particularly affected by the victim's story and wanted to help her.

In August of 2007, after working almost a decade for an organization in Nova Scotia, our client could no longer tolerate the work environment that she was being subjected to, and resigned from her position. Our investigation revealed that other employees experienced the same problems as our client.

Leading up to her resignation, our client experienced both physical and verbal harassment. She was subjected to derogatory remarks, physical and verbal threats, intimidation, and ridicule.

As the harassment worsened, our client sought help from her superiors. She reported the harassment, but her complaints were dismissed and she was called a "trouble maker". She then reported the behavior to the next level of management, and as she complained through the rankings, she was repeatedly dismissed. Furthermore, each time our client sough help in what she believed to be a trusted and confidential environment, her complaints were reported to her abuser which only intensified the level of harassment that she experienced. All of this disempowered our client even further, accelerating and escalating the abuse and harassment as her perpetrators became more emboldened.

Our client was trapped, powerless, and being abused. She had no other option but to resign from her workplace. As a result, she suffered personal injury including emotional and financial strain.

In December 2014, she settled the case and secured $70,000 for our client.
